New State legislation, the Secure Choice Act, now makes it mandatory to have a retirement plan in place for small businesses that employ 25+ people. Beginning November 1, 2023, it will also apply to employers with 5+ employees.

Large businesses with 100+ employees must also comply with the Federal law, Secure 2.0 of 1999 and 2022, which encourages employers to offer Retirement Savings plans by reducing costs and offering tax breaks. However, there are many provisions that also apply to small businesses under 100 employees.
